Legal Update

In March 2003, a group of Tittabawassee River area residents filed a lawsuit against The Dow Chemical Company. The Plaintiffs claim that their properties have been devalued as a result of the elevated levels of dioxins and furans found in the area, and also sought to establish a medical monitoring fund.

In June 2004, the Michigan Supreme Court agreed to hear Dow’s appeal of the issue that the medical monitoring portion of the suit be dismissed. The Michigan Supreme Court put on hold all proceedings in the lawsuit, including the trial court’s determination of whether to certify as a class.
